Terms of Service
Last updated October 18, 2026
Agreement
These terms cover your use of rackrate.ai and Rack Rate's customer onboarding service, run by RackRate Inc. ("Rack Rate", "we"). By using the site or signing in, you agree to them. If you use the service for a company, you agree on its behalf and confirm you are allowed to. A signed agreement between your company and Rack Rate for a deal takes precedence over these terms where they differ.
What we provide
The public site publishes market information about AI infrastructure: hardware prices, listings, analysis and the daily brief. The onboarding service lets invited customers store company information and documents, and lets us prepare compliance packets for hardware orders they ask us to work on.
Market information is not advice
Prices, listings and analysis are provided for information only. They may be incomplete, delayed or wrong, are not an offer to sell, and are not financial, legal or investment advice. A price or availability is binding only when confirmed in a signed quote or order.
Accounts
Onboarding accounts are by invitation. Keep your sign-in email and Google account secure, use your own account rather than sharing one, and tell us promptly at legal@rackrate.ai if you think someone else has used it. You are responsible for what is done through your account.
Your content
You keep ownership of the information and documents you or your colleagues provide. You give us permission to store, process and share them as needed to run the service and prepare the compliance packets you ask for, as described in our Privacy Policy. You confirm that what you provide is accurate and that you have the right to share it. Certifications you sign are your own statements to the hardware maker.
Acceptable use
Don't break the law using the service; misrepresent who you are or who the end user of hardware is; try to get around export controls; access accounts or data that aren't yours; probe, overload or disrupt the service; or copy or resell the site's market data in bulk without our written permission.
Compliance decisions are not ours alone
Hardware makers, and in some cases governments, decide whether an order is approved and when it ships. We help prepare and submit information but do not guarantee any approval, delivery date or outcome.
Our content
The site, its design and its market data belong to Rack Rate or its licensors. You may read and share individual pages and quote small parts with attribution.
Availability and changes
We may change, suspend or stop parts of the service, and may suspend accounts that break these terms. We try to keep the service available but do not promise it will be uninterrupted or error-free.
Disclaimers
The service is provided "as is" and "as available". To the extent the law allows, we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement.
Limitation of liability
To the extent the law allows, Rack Rate is not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data, arising from the service. Our total liability for any claim about the service is limited to the greater of US$100 and the fees you paid us for the service in the 12 months before the claim. Nothing here limits liability that cannot be limited by law.
Changes to these terms
We may update these terms. We will change the date at the top, and tell onboarding customers by email if a change is significant. Continuing to use the service after a change means you accept it.
